When do I legally need a SWMS?

A SWMS is required before any high-risk construction work begins — there are 18 categories under the WHS Regulations, including work at heights above 2m, work near live electrical, demolition, confined spaces and more. It must be prepared in consultation with workers and kept on site.

What counts as high-risk construction work?

Categories include working at height, work on or near energised electrical installations, work in confined spaces, demolition, asbestos, work near traffic, trenching, and several others. If your task falls into any of them, a SWMS is mandatory.
