Please read these Terms of Service carefully before using traqR. By accessing or using the platform, you agree to be bound by these terms.

Acceptance of Terms

By creating an account or using traqR (“the Service”), you agree to these Terms of Service and our Privacy Policy. If you do not agree, do not use the Service.

These terms apply to all users including business administrators (“Organisations”) and field staff (“Workers”).

Description of Service

traqR is a field service management platform that enables trades businesses to manage jobs, workers, timesheets, scheduling, purchase orders, and related operations.

We reserve the right to modify, suspend, or discontinue any part of the Service at any time with reasonable notice.

Account Responsibilities

  • You must provide accurate and complete information when creating an account.
  • You are responsible for maintaining the confidentiality of your login credentials.
  • You must notify us immediately of any unauthorised access to your account.
  • You must be at least 16 years of age to use the Service.

Organisation Responsibilities

Organisations that subscribe to traqR are responsible for:

  • Ensuring workers are informed about the data collected about them via traqR.
  • Obtaining any required consents from workers for data collection (including location and sensitive financial data).
  • Complying with applicable employment laws, payroll obligations, and Fair Work requirements.
  • Ensuring the accuracy of payroll and tax information entered into the platform.

Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any applicable law or regulation.
  • Attempt to gain unauthorised access to any part of the Service or other users' accounts.
  • Upload or transmit malicious code, viruses, or harmful content.
  • Reverse engineer, decompile, or attempt to extract the source code of the Service.
  • Use the Service to store or transmit infringing, defamatory, or otherwise unlawful content.

Subscription & Billing

Access to the full traqR platform requires a paid subscription. Billing is processed securely via Stripe.

  • Subscriptions are billed on a recurring basis (monthly or annually as selected).
  • You may cancel your subscription at any time; cancellation takes effect at the end of the current billing period.
  • Refunds are not provided for partial billing periods unless required by Australian Consumer Law.
  • We reserve the right to change pricing with 30 days' notice.

Data & Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

You retain ownership of all data you input into traqR. We do not claim any ownership rights over your business data.

Upon account termination, you may request an export of your data within 30 days. After this period, data may be permanently deleted subject to our retention obligations.

Intellectual Property

traqR and its original content, features, and functionality are owned by [COMPANY LEGAL NAME] and are protected by Australian and international copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable licence to use the Service for your internal business purposes only.

Limitation of Liability

To the maximum extent permitted by law:

  • The Service is provided “as is” without warranties of any kind.
  • We are not liable for any indirect, incidental, special, or consequential damages arising from your use of the Service.
  • Our total liability to you for any claim shall not exceed the fees paid by you in the 12 months preceding the claim.

Nothing in these terms limits rights you may have under the Australian Consumer Law that cannot be excluded by contract.

Indemnification

You agree to indemnify and hold harmless traqR and its officers, directors, and employees from any claims, damages, or expenses (including legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.

Termination

We may suspend or terminate your access to the Service immediately and without notice if you breach these Terms or if we are required to do so by law.

You may terminate your account at any time by contacting us or through the account settings.

Governing Law

These Terms are governed by the laws of [YOUR STATE, e.g. New South Wales], Australia. Any disputes shall be subject to the exclusive jurisdiction of the courts of that state.

Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated via email or in-app notification at least 14 days before they take effect. Continued use of the Service after changes take effect constitutes acceptance of the new Terms.
